Deliberative democracy is a revolutionary political ideal that requires fundamental changes in political institutions, bases of collective decision making, and the distribution of resources. Perhaps because of its revolutionary character accounts of deliberation in political theory thus far have offered little guidance for actors in actually-existing democratic circumstances. This article develops an ethical account of deliberative democratic action under imperfectly just conditions characterized by material and political inequality and failures of reciprocity. Under such conditions, appropriate principles of action can resolve (...) the tension between deliberation and confrontational political activism. The logic of this account parallels the justification for civil disobedience: the extent of permissible deviationfrom deliberative norms increases according to the adversity of political circumstances. This ethical account is composed of principles of deliberative activism, applications of those principles to four kinds of increasing unfavorable circumstances, and a menu of institutional and political strategies that increase deliberative inclusion and equality. As behavioural economics reveals, human decision-making deviates from neoclassical assumptions about human behaviour and people (often) fail to make the ‘right’ welfare-enhancing choice. The purpose of Sunstein and Thaler’s concept of ‘nudge’ is to improve individual welfare. To provide normative justification, they argue that the only relevant normative criterion is whether the individual is ‘better off as judged by themselves’, so that the direction in which people are to be nudged is defined by their own preferences. In light of behavioural (...) findings, however, people’s choices do not provide a sound basis for eliciting preferences and thus for assessing welfare. In this paper, I aim to challenge Sunstein and Thaler’s normative view, arguing that it is unreasonable to rely on conventional welfare economics, particularly considering the given context. Sunstein and Thaler depend on an approach of ‘preference purification’ which assumes informed, latent, and true preferences: As a result they face crucial methodological, epistemological, and practical objections, and cannot show how their approach enhances individual welfare. By building on the concepts of R. Sugden and C. Schubert, I develop an alternative normative framework for behavioural public policy, based on a contractualist perspective in which people may consent to collective choice rules in order to align future behaviour with values, to achieve particular goals or to preserve personal integrity. Individual consent and citizens’ participation and deliberation are crucial to this approach. This contractualist approach may provide a normative justification for behavioural public policy, and help to reconcile behavioural and normative economics. (shrink)

In this article, I shall try to argue that some existing interpretations of the Analects cannot provide a satisfactory understanding of the concept of ren, on the one hand, and the relation between ren and li, on the other. Ren is not a thin concept such as right and wrong, good and bad, because it is not a non-substantive concept whose descriptive content has to be identified by a specific criterion which is not included in the concept itself. It is (...) also not or not merely a thick concept such as courage, cruelty, truthfulness, and kindliness. In comparison with a thick concept, ren like courage, but unlike right, has substantive content. Nevertheless, unlike courage and other thick concepts, ren is not only about the ideal quality of a virtuous agent and the moral property of the agent's actions; it is also about the internal capacity of the agent and the principle believed by the agent for making moral actions. Since the meaning of the term is not only related to the external behavior but also related to the internal mind and the relevant principle, here, I call ren a “heavy” concept. It is “heavy” in the sense that it is not a concept of observable or substantive entity, but a theoretical construct which is used to explain the complicated relational property of morality, that is emerged from the internal realm and exhibited in the external realm of an agent. Human rights are often taken for granted, but "What is the basis of human rights?" This is no easy answer, De Xiao Weiqi, in his 2004 book of this difficult the problem. Human rights are often taken for granted but in fact the origin or foundation of human rights is not an easy question. Alan Dershowitz tries to tackle this thorny issue in his 2004 book: Rights from Wrongs: A Secular Theory of the Origins of Rights. He mainly considers four theories: 1) externalism, eg, the divine source of human rights theory; 2) Internalism, eg, legal positivism; 3) Rationalism, eg, the claim that human rights are founded upon rational intuitions; 4) Experiential approach, ie, human rights are derived from our historical experience of serious wrongs or injustice. He severely criticizes the first three theories, and defends the fourth. In this article, I will point out that despite quite a few merits of Dershowitz's theory; his criteria for the validation of human rights are vague or even inconsistent. His general stance of constructivism towards moral and human rights claims, moreover, are unable to provide solid foundations for human rights. In fact Dershowitz is to some extent aware of these problems, and he feels that human rights do need an objective external source, if only it is possible. I think the theistic worldview is indeed able to provide this objective external source. Dershowitz has raised a lot of good questions for the divine source theory but I argue that in the end they cannot exclude the possibility of a contemporary Christocentric theory of human rights. They have, to a great extent, achieved their goal to explain music learning from a life-world approach. Descriptions of absolute musicality and relativistic musicality in the opening paragraphs remind me of the good old "nature versus nurture" argument. (...) Do the authors intend to relate musicality to musical ability or aptitude as defined by psychologists? If musicality is "the ability to make something of one's own," does it mean that the authors have taken on a relativistic view and believe that musicality can be acquired?At the onset of the essay, musicality is described as emotional or cognitive phenomena. I would be interested to know what role a psychomotor phenomenon plays in musicality. The authors later describe "motor knowledge" in the context of Merleau-Ponty's "maximum grip." Does it mean that "motor knowledge" or "maximum grip" in music is outside the realm of musicality?I have attempted to follow the authors' logic in answering the question: What is learning of music? The authors postulate that "knowledge does not always, and not in any way automatically, become exactly the same as the learning situation aimed for" and that "the aim of music education is to produce music knowledge." These propositions lead me to believe that the learning of music occurs in experiencing all types of musical activities, regardless of the musician's level of proficiency. In all types of musical activities, including different performances of the same repertoire by the same performer, the musician would find new knowledge that is being produced in his/her body. Therefore, I agree with the authors in that "bodily experience is the foundation for learning."I would like to respond to the issue of whether music learning occurs within [End Page 206] or outside of the human being. I enjoy reading how the authors borrow Merleau-Ponty's analogy of the blind man and his stick. They put it so beautifully that "the piano becomes an extension of the pianist's body, and the pianist can 'feel' its limitation." This leads me to ponder if there could be further extensions beyond the physical piano. We know that pianists make the strings in the piano vibrate through a lever mechanism. These vibrations travel through the air and arrive at the audience's ears. Then the vibrating energies are transmitted as electrical energies in the audience's nerve cells. The audience in turn may behave differently after such a complex transmission of energies at a performance. My question is: Is there an end to the "extension" of a musician's body? If so, where should it end? There is no doubt that the pianist relates to the world and learns about the world through the piano. Could the pianist learn about the world through the vibrations that the piano strings generate, through the air, and through the audience's hearing mechanism, brain cells, and behaviors? Is this what the authors meant by "the human ego is boundaryless and cannot be localized, and the ego is immanent in the whole system"? Regardless of how far the "extension" goes, how do we know if an "extension" has occurred? How can we validate an "extension" of a musician's ego"?It seems to me that the authors' discussions have focused on the tactile extension of the body. If the body can be extended like the stick for the blind man, would the air surrounding the blind man, including its smell, temperature, humidity, wind, and sound, be his extension too? When this question is transferred to a musician, would the total context of the musical event be the musician's extension of the body too? The translation of philosophical works is a topic that merits our attention both in respect of philosophical understanding and linguistic structure, although it is the former rather than the latter that prevails in discussions in Chinese academia. By drawing upon that branch of modern linguistics known as the lexical field theory, this paper attempts to analyze a host of related problems, including the following: readability as a basic requirement of translation, difficulties in translation caused by the syntactic-typological distance of source (...) and target languages, consistency of translated terms in general, consistency of semantically related terms in translation, consistency of translated terms regarding the syntagmatic axis and the paradigmatic axis, the use of monosyllabic, disyllabic, or polysyllabic Chinese terms in translation, translation of long or rare terms into Chinese, the middle way between ‘under-translation’ and ‘over-translation,’ identification of lexical fields for the systematic treatment of translated terms, and finally the in-depth understanding of original texts in their source languages as a prerequisite of any serious attempt of translation. Fan Zhen’s 范縝 Shenmielun 神滅論 is a famous Chinese treatise discussing the body-soul problem. This discussion had been advocated by Huan Tan 桓譚 and Wang Chong 王充. However, their views did not receive positive attention: at the beginning of the Eastern Han dynasty, their intellectual weight was far from significant enough to spur the court’s interest in the topic. During the time of Fan Zhen, Emperor Wu of Liang, a keen protector of the thought of dharma, raised the question of (...) the soul and the body to a political level, making it the focus of academic debate. The aim of this article is to give a comprehensive account on the development of the idea of the nonidentity and inseparability of the body and the soul as promulgated by Fan Zhen and his predecessors from the perspective of the history of ideas. Starting from the Humboldtian characterization of Chinese writing as a "script of thoughts," this article makes an attempt to show that notwithstanding the important role played by phonetic elements, the Chinese script also relies on visual-graphical means in its constitution of meaning. In point of structure, Chinese characters are made up predominantly of components that are sensible or even tangible in nature. Out of these sensible components, not only physical objects or empirical states of affairs can be expressed, but also (...) the most subtle and abstract concepts, such as 萬, 它, 言, 災, 仁, 義, 思, 念, 法, 律, 善, 考, 莫, 瞏, and 幾, attesting to what Humboldt says about the Chinese script as having "embraced philosophical work within itself." Humboldt's idea of "analogy of script" throws light on the mechanism behind this structure to stimulate new reflections on the traditional theory of the "Six Ways" (六書) of character formation to provide a productive platform for interpretation. Confucius endorses a balance between generalism and particularism in ethics and aesthetics. Rather than standards, his rules are defeasible guides for perception, thought, and action balanced by particularizing capacities of judgment. These rules have opaque and open-ended hedges that strengthen a generalization by restricting its application. A similar architecture for ethical and aesthetic rules reflects a broad view of ethics and aesthetics as intertwined and continuous. Hence, whether one chooses a generalist or particularist ethics depends on one's corresponding choices in (...) aesthetics, and vice versa. The negative co‐variation of life‐history traits such as fecundity and lifespan across species suggests the existence of ubiquitous trade‐offs. Mechanistically, trade‐offs result from the need to differentially allocate limited resources to traits like reproduction versus self‐maintenance, with selection favoring the evolution of optimal allocation mechanism. Here I discuss the physiological (endocrine) mechanisms that underlie optimal allocation rules and how such rules evolve. The hormone testosterone may mediate life‐history trade‐offs due to its pleiotropic actions in male vertebrates. Conservation in the actions (...) of testosterone in vertebrates has prompted the ‘evolutionary constraint hypothesis,’ which assumes that testosterone signaling mechanisms and male traits evolve as a unit. This hypothesis implies that the actions of testosterone are similar across sexes and species, and only the levels of circulating testosterone concentrations change during evolution. In contrast, the ‘evolutionary potential hypothesis’ proposes that testosterone signaling mechanisms and male traits evolve independently. In the latter scenario, the linkage between hormone and traits itself can be shaped by selection, leading to variation in trade‐off functions. I will review recent case studies supporting the evolutionary potential hypothesis and suggest micro‐evolutionary experiments to unravel the mechanistic basis of life‐history evolution. Despite their potential for facilitating interaction between a user and computer, an embodied agent and voice command have not been examined enough for their matching effects. The current study proposes that an embodied agent and voice command generate positive evaluative outcomes, particularly when they are accompanied by each other. To test this prediction, we conducted a 2 (visual output: embodied agent vs. geometric figure) × 2 (input modality: voice command vs. remote controller) between-subjects experiment (N = 52), and examined whether (...) visual output and input modality jointly influence participants’ social attribution (i.e., anthropomorphism, animacy, likability, and perceived intelligence), social presence, and satisfaction. Results show that voice command does facilitate users’ social attribution and social presence, but only when an embodied agent was presented. Also, the effects of voice command on social presence and satisfaction were mediated by anthropomorphism and perceived intelligence respectively, but only when the interface displayed an embodied agent. The present study evidences the holistic nature of human-computer interaction, revealing the importance of matches in the input and output interface. (shrink)

New technologies not only contribute greatly to society and the economy; they also involve fundamental societal shifts, challenging our values and ideas about ourselves and the world. With a view to aligning technological change and innovation with ethical values, the concept of responsible innovation advocates the inclusion of a variety of stakeholders, in particular from society. In shifting moral responsibility towards the producers of innovations, responsible innovation rejects the standard normative economic view that the ethical evaluation of innovations is a (...) matter of individual consumers’ market-based choices. However, in this article we argue that responsible innovation should not abandon all normative consideration of the individual outright, to which end we present an alternative normative economic approach based on preference learning. We show how this approach can provide an enhanced understanding of responsible innovation by clarifying the redistribution of moral responsibility and casting individuals in the normative role of co-innovators, rather than mere consumers. We argue that responsible innovation should enable individuals to form preferences and evaluate innovations, so as to align innovation with ethical demands. Finally, we show how our proposed approach can be put into practice in so-called laboratories in real-world contexts, using methods from the field of design. In short, drawing on normative economics, this article aims to establish a new understanding of responsible innovation that is conceptually sound and can form the basis for novel innovation practices. When ethics committees are consulted about patients who have or need court-appointed guardians, they lack empirical evidence about several common issues, including the relationship between guardianship and prolonged, potentially medically unnecessary hospitalizations for patients. To provide information about this issue, we conducted quantitative and qualitative analyses using a retrospective cohort from Veterans Healthcare Administration. To examine the relationship between guardianship appointment and hospital length of stay, we first compared 116 persons hospitalized prior to guardianship appointment to a comparison group (n (...) = 348) 3:1 matched for age, diagnosis, date of admission, and comorbidity. We then compared 91 persons hospitalized in the year following guardianship appointment to a second matched comparison group (n = 273). Mean length of stay was 30.75 days (SD = 46.70) amongst those admitted prior to guardianship, which was higher than the comparison group (M = 7.74, SD = 9.71, F = 20.75, p. (shrink)

In this article, I show how the principle of democratic self-determination can answer the boundary problem by both grounding and constraining a people’s right to exclude potential immigrants. I argue that a people has the qualified right to exclude insofar as it respects the self-determination claims of outsiders. I analyze the concrete implications of the requirement to respect the self-determination claims of outsiders in the cases of long-term residents, refugees, and brain drain. When heterosexuality dominates sexual culture, sexual minorities are marginalised, yielding minority stress and internalised phobia which devastate psychological well-being and raise suicide risks. A growing trend in using mindfulness-related interventions in health care shows positive signs, but there is a paucity of research on mindfulness for sexual minorities. This qualitative research, through interpretative phenomenological analysis, looks into how Buddhist sexual minorities (from various countries) interpret mindfulness from which their increased self-awareness, self-esteem and self-acceptance become prominent intrinsic resources, resulting in enhanced (...) mental health and quality of life. Such an exploratory study extends the horizon of health care benefits for helping professionals and sexual minorities with alternative views in overcoming external and internalised phobia. (shrink)
